From 1 October 2026, new Right to Rent rules will come into effect in England. The changes are designed to strengthen compliance and update the way eligibility checks are carried out.
For most private landlords and letting agents, the basic requirement remains the same: you must check that all adult tenants have the legal right to rent before the tenancy begins. However, some organisations that arrange accommodation as part of employment or contractual work may also have new legal responsibilities from October 2026.
The Home Office is also updating the way Right to Rent checks can be completed, with greater use of approved digital identity verification services where appropriate.
Landlords, letting agents and businesses involved in providing accommodation should review their procedures before the new rules take effect to ensure they remain compliant with the latest requirements.
